$22.5 million dollar settlement for the failure to diagnose and treat a sinus infection leading to catastrophic brain injury.

In October 2026, Sukhman | Yagoda settled a central Illinois case against a hospital, a radiologist, an emergency room physician, and a pediatrician for their failure to timely diagnose and treat an eight-year-old boy’s sinus infection that resulted in a subdural empyema and severe brain injury. The Defendants failed to consult with an ENT despite the child being seen in the ER three times in five days for severe 10/10 one-sided headaches, photophobia, lethargy, and CT Scan findings of serve paranasal sinus disease and frontal bone dehiscence. Both Plaintiff and Defense experts agreed that earlier ENT treatment and IV antibiotics would have prevented the child’s brain injury.
